Case 99-991 (UCPD) Rivera

Note: This crime report is made up of separate police reports and is organized chronologically.

[2] On 10 August 1999 at 1100 hrs, the Upper Chichester Twp. Police received a call to 2429 2nd Ave. Upon arrival, Ofc. Erb spoke to Sheila Clendening. Clendening said that the suspect forcibly entered the rear door of the residence where she was providing child care for the Helton child, Katelyn (20 months of age). Clendening said that the suspect damaged the rear door of her home. Clendening said that once the suspect entered the home he pushed her out of the way to gain access to the child. Clendening said that the suspect carried the child out the front door of the home. Upon exiting the child struck its head on the door jamb causing a small laceration. Photographs were taken of the damage to the home. (Enclosed in case file) Det. Reardon responded and took written statements from Shiela Clendening and her daughter Jamie Clendening. This incident is in violation of a Protection from Abuse Order # 994-10047 dated August 5, 1999 signed by the Honorable Judge Ann Osborne. Order is in effect for one year. (Copy enclosed in Case File)

This officer spoke to the owner of the vehicle, Michele Lupi. Lupi said that she lent her vehicle to the suspect to go to court today. Lupi said that the suspect was suppose to pick her up at work for lunch but he did not show. Lupi said that he is suppose to pick her up at 1630 hrs. Lupi said that she works for Keystone Health in Essington. This officer notified Tinicum Police to check the area at that time. Tinicum said that they checked and he did not show.

A bolo was broadcasted and the suspect was entered into NCIC.

At approximately 1600 hrs, Helton called and said that the suspect keeps calling the house. This officer called Bell Atlantic Security and had the number traced. The number came back to the aunt's house.

[3] On Tuesday 08/10/99 at 1805 hours, Ptlm. Smoak handled a call at 2623 Sharpless Ave. that was reported to Delcom as a prior abduction. Upon arrival, Jennifer Helton stated that Robert Rivera had just left in a maroon vehicle last seen west on Meetinghouse Rd. While at the residence writer did speak with Rivera on the telephone requesting him to returned his daughter. He indicated that he would only could meet with Jennifer and he will turned himself in at 8490. Jennifer stated that she will meet him at Carpenter Plaza in State of Delaware.

On Tuesday 08/10/99 also reported at 1805 hours, Cpl. Hickey received a call from Delcom reporting an unwanted subject at 2623 Sharpless Ave. Jennifer Helton of 2623 Sharpless Ave. (494-0379) contacted 911 and advised that Robert Rivera was in front of her house with their daughter, who he had earlier abducted. Rivera was reported to be driving Michele Lupi's 1995 Ford Escort, maroon in color, 4dr. and bearing Pa registration number BHD2395. Prior to Police arrival, Del-Com advised he had left the area and was last seen on Meetinghouse Road toward Chichester Avenue. Writer requested priority and a search of the area began for Rivera. Off. Smoak responded directly to the scene to obtain further information from the victim. While searching the area, Jennifer received a call from Rivera. Rivera wanted to meet her at the Tri-State Mall in Claymont, Delaware to return their 20 month-old daughter. Rivera was requesting to meet her in front of the K-Mart Store. Rivera hung up after making the request.

On Tuesday 08/10/99 at 1835 hours, Cpl. Hickey, along with Cpl. Webb met with Delaware State Police Cpl. Michael Smith (302-761-6677) at the Tri-State Mall. We advised him of the situation involving Rivera and that we had Felony Warrants for Kidnapping and Assault for Rivera. We had learned that Rivera had again called Jennifer Helton and was requesting to meet her at Carpenter Plaza so he could return the child. Cpl. Smith was provided with all the necessary information concerning our investigation. He advised that if a meeting should be arranged in Delaware and a surveillance was needed that they would provide assistance. He requested we fax him a copy of Rivera's NCIC entry. Del-Com did fax the information requested to DSP 302-762-6787. Also, during this time Lt. Harris who was off-duty heard the radio transmissions concerning Rivera. He contacted writer by phone and offered his assistance. He responded to Carpenter Plaza in his own vehicle and began a surveillance of the parking lot in case Rivera showed up. Rivera however eluded Police and was not apprehended at this time.

On Tuesday 08/10/99 at 1900 hours, Cpl. Hickey had requested Det. Reardon be contacted and respond to assist with this investigation. He met writer and assisting officers on Ryans Run, a short distance from Carpenter Plaza. It was decided that Det. Reardon would respond to Helton's residence on Sharpless Avenue and stand-by in case he called again. Off. Smoak who had been with her advised that at one point he actually spoke with Rivera on the phone and attempted to convince him to surrender. Rivera advised he would surrender only after meeting with Jennifer. Det. Reardon responded to Helton's residence and relieved Off. Smoak.

[4] On Tuesday 08/10/99 at 2020 hours Cpl. Hickey was requested to call Cpl. Smith from DSP at 302-761-6677. Cpl. Smith requested additional information for his report, same was provided.

On Tuesday 08/10/99 at 2045 hours, Cpl. Hickey interviewed Michele Lupi of 2522 Bethel Rd. Chester, Pa (497-4004) at Police Headquarters. A statement was obtained from her concerning Rivera. Briefly, she advised that she drove Rivera to Linwood Court this morning for his hearing with Helton. They arrived at approx. 0815 hours. Rivera asked her if he could drive her to work and drop her off and use her car. She agreed and she went to work and he returned to Court in her car. At approx. 1730 hrs, he arrived at her work and she met him in the parking lot. At this time, he had his 20 month old daughter with him. She advised she appeared okay and did not appear injured or frightened. They left and he drove to the Wawa Store at Ridge and Naamans Rd. in Delaware. He called Jennifer from a pay phone and she heard him requesting her to meet him at the K-Mart Store. After hanging up he drove to Sharpless Ave. and stopped in front of Jennifer's house and beqan blowing the horn. She﷓states Jennifer came to the door and asked him to wait a minute and she then disappeared inside. At this point Rivera drove away. Michele told Rivera she wanted no part of what was going on and requested he drop her off at Shawn Holton's house on Jones Dr. in Linwood. Rivera dropped her off and told her he would return in 15 minutes. He never returned so she decided to call the Police. She was advised to contact Chester Twp. Police to report her car either stolen or as an Unauthorized Use. Refer to statement in case folder.

On Tuesday 08/10/99 at 2117 hours, Det. Reardon contacted Cpl. Hickey to advise that Rivera had made another call to the house. Det. Reardon spoke with him and requested he return the child to Jennifer. He advised he would be there in 5 minutes. At this time, a surveillance was setup watching the Helton residence. Off. Montgomery, Off. Erb and Cpl. Hickey were stationed in the area awaiting Rivera's arrival. We conducted the surveillance until 0200 hours on 08/11/99. We had not heard from him again and he was not seen in the area. Det. Reardon had contacted Bell Security for a trace on the line, which was approved, however, Rivera never called back. Terminated at 0200 hours.

[5] On Tuesday 08/10/99 at 2327 hours, while Det. Reardon was on location at 2623 Sharpless Ave., he requested possible contact people for Rivera. Jennifer Helton was able to provide two number that she retreived from Rivera’s Chi Ave. apartment. One number was for a Crystal (number 610-364-9187). Reardon made contact with Crystal (ID'd as Crystal Hickey 3390 Chi Ave. Apt. E-8). Crystal advised that on Friday 08/06/99, she was at Wheatey Amoco with a friend getting gas and Rivera was there and had asked her for her phone number. She gave him her beeper number, but has not heard from him since. Reardon also paged a girl named Tara (old girl friend of Shawn Holden and Robert Rivera) at 610-490-4981. Reardon received a call back, but learned that this pager number was just given to (past two weeks) a new client named Peggy Haley of Holmes Pa. Haley does not know Rivera.

On Wednesday 08/11/99 at 0021 hours, Det. Reardon contacted Rivera's sister, Lisa McLarty (31 A Crader Lake Dr. Cora, NJ. 11727 516-928-0939). She advised that she has not heard from Rivera. She was advised that Rivera has the child and the pending charges. She will contact our PD if she should hear from Rivera.

On Wednesday 08/11/99 at 0825 hours, Det. Reardon contacted the Lupi residence (497-4004) looking for Michelle. Michelle's mother advised that Michelle has not returned home from 8/10/99. She will contact our PD when she returns.

[6] On Wednesday 08/11/99 at 1035 hours, Ptlm. Gray (UCPD) received a landline call from Jennifer Helton. Jennifer advised Gray that she just received a phone call from Rivera. Rivera requested Jennifer to run down the street to meet him. He wanted to talk to her. Jennifer wanted to know where Katlyn was and Rivera advised that he would tell her if she met him. Rivera then hung up the phone. Jennifer completed a *57 trace on this call and then *69’d the call. She advised that the *69 came back to 302-798-4920. At this time, Lt. Harris contacted Bell Atlantic Security (1-800-679-4774) and obtained an origin of the call at a payphone located at Tracey's Gulf of United Teleconnect address: 11 Grandview Ave. in Brookhaven. At this time, thinking that Rivera is calling from the Tom Jones resturaunt, a Brookhaven PD car is sent to that location. Upon arrival at Tom Jones, Brookhaven PD advised that said Tracey's Gulf is owned by United Teleconnect and the address is Naamans Rd. and Peachtree Rd. in Claymont De. At this time, Delcom is advised to send a Delaware officer to that location and a UCPD car was also enroute. Severl minutes later, at about 1045 hours, Jennifer Helton made another call to UCPD HQs. Again, Rivera called her residence requesting again requesting to meet at the Chi Middle School (925 Meetinghouse Rd.). Rivera tells Jennifer to run down the street and he would pick her up. He still was not telling Jennifer where Katlyn was. A trace *57 was completed again to number 610-494-9275. Again, Lt. Harris made contact with Bell Atlantic Security and leanred that said number comes back to the Exxon Station located at Market St. and I-95. At this time, officers from UCPD were requested to respond to this location. While enroute to this Exxon station, Jennifer again called UCPD HQs and advised that Rivera was now down the street from her home and that her brother and father were chasing him. It was later learned, from Frank Helton (father), that he and his son observed Rivera in the previously mentioned 95 Ford Escort at Meetinghouse Rd. at the end of Sharpless Ave. They ran to their vehicle in an attempt to chase Rivera. By the time he got to the end of the street, he had lost sight of Rivera. He then returned home. Ptlm. Massey (UCPD) responded directly to the Helton residence, while other officers patrolled the area looking for Rivera. While patrolling the area, a third call is made by Rivera to the residence at about 1050 hours. Olga Helton (mother of Jen) picked up the phone and spoke to Rivera. Rivera was asking for Jennifer and Olga advised that she was not on location. Rivera was asked where was Katlyn and responded that he had given her to a women friend no one knows about, that she lost a girl, and that she will take good care of Katlyn. Several other items were discussed (See interview sheet for details) before Rivera hung up. Another *57 trace was completed by Olga and it was reported over Delcom that the call was originating from a local payphone at a Chinese type resturant. An exact location was not reported and Rivera was not located.

On Wednesday 08/11/99 at 1138 hours, Det. Reardon, #24 was assigned by Lt. Harris to maintain an interior surveillance at the Helton residence. While on location, Reardon contacted Bell Atlantic Security (1-800-286-3553) and spoke with a Jesse Davis. Reardon requested that a live trace be placed on the Helton's phone line. Davis advised that a signed letterhead from the Helton's was needed for security/legal purposes in order to conduct a live trace. The Helton's responded to UCPD HQs and a released (typed by 8492 Bulley) was typed, signed by the Helton's, and faxed to Bell (# faxed to: 1-800-286-4774). The fax was recieved and a live trace was opened.

[7] On Wednesday 08/11/99 at 1345 hours, Det. Reardon was on location at the Helton residence w en Rivera made a collect call. Jennifer picked up the phone and spoke with Rivera. Jennifer was asking Rivera where was Katlyn, but Rivera made statements that Katln was in a safe place (Refer to subsequent interview info that was obtained by Lt. Peifer and SA Kibbie). Det. Reardon requested to speak with Rivera. He did breifly speak with Reardon. He said he was going to turn himdelf in, but he would needed to speak with Jennifer. Rivera indicated :hat he was going to hang up, so the phone was given back to Helton. Helton tried to speak Rivera, but Rivera hung up. At this time, Det. Reardon referred to a new caller ID box that was just placed on the phone prior to Rivera's call. It displayed a number of 610-494-9275. Det. Reardon recognized this number as originating from the Exxon Station payphone (Market St. & I-95) and dispatched UCPD to that location. At 1458 hours Robert Rivera pulled up in front of 2623 Sharpless Ave. in the 95 red Ford Escort. He began angerlv honking the horn yelling for Jennifer to "come on" and get into the car. Det. Reardon requested Jennifer to stand in the door way of the porch and request that Rivera come into the house. At 1349 hours, Assisting officers arrived and boxed in Rivera's vehicle as he attempted to flee. Rivera was taken into custody without incident and placed into the rear of patrol unit #3. At 1352 hours, Det. Reardon mirandized Rivera and he waived his right to counsel. Det. Reardon asked Rivera the whereabouts of Katlyn Rivera and Rivera refused to disclosed that information. The vehicle was inventoried and impounded at Sam's Atlantic Auto Body (See tow report). A white envelop containing items for Robert Rivera was taken as evidence. Rivera was transported to police HQs by Lt. Harris. Rivera was processed on the charges related to the incident at the Wawa and 2nd. Ave. on 8/10/99 at 1055 hours. After being processed, an interview was conducted of Rivera by Lt. Donald Harris and Det. Reardon. Numerous senarios were played out for Rivera as related to possible time in prison in order to entice Rivera into disclosing Katlyn's whereabouts, all with negative results. A photograph of Katlyn was shown to Rivera. Rivera became emotional towards the photo (crying at times), but he refused to disclose that information.

On Wednesday 08/11/99 at 1500 hours, Rivera indicated that if he could speak with Jennifer, that he might disclose the whereabouts of Katlyn. At 1520 hours, Jennifer Helton arrived at police HQs where she agreed to meet and speak with Rivera. Rivera was secured to a chair in the conference room of the Twp. building. Both Jennifer and Rivera spoke for nearly 1 hour 20 minutes. Det. Reardon maintained a post outside of the conference room door. Det. Reardon could not hear the conversation between Jennifer and Rivera, but Reardon could hear both Jennifer and Rivera crying at times and they were talking about the problems between them. Rivera appeared not to tell Jennifer anything about Katlyn or her whereabouts. On three occasions during the meeting, Jennifer opened the door to indicate that she was fine and asked for more time to talk. After about 1 hour, 10 minutes, Det. Reardon opened the door to check on Jennifer. At this time, Det. Reardon observed Jennifer standing on the same on the table side as Rivera in front of him. Jennifer turned to Reardon and advised that she was fine and everything was going ok. At about 1 hour, 20 minutes, Det. Reardon again opened the door and this time entered the room. Det. Reardon observed that Jennifer was now sitting on Rivera’s lap with her arms around him. Jennifer indicated that they are finished talking. At this time, Jennifer was advised to leave the room and speak with Lt. Harris outside. Det. Reardon then requested Rivera disclose the whereabouts of Katlyn. Rivera refused. He stated that in his heart, he knew Katlyn was in a safe place, being taken care of. He would take it to his grave and not tell anyone where she is.

[8] At this time, Jennifer walked back into the room and pleaded with Rivera. Rivera got very upset, telling Jennifer that everything they just talked about was bullshit and that she is never going to see Katlyn again. He told Jennifer that she could just consider Katlyn dead because she is never going to see her again. Jennifer was removed from the room. At this time, Det. Reardon began requesting repeatedly that Rivera disclose where Katlyn was. Reardon stated that the police gave him what he wanted (that was being able to talk with Jennifer), and he stated that he would tell the police. Rivera immediately said that he might tell the police, but he did not make any promises. Whatever Rivera's exact words were, he indicated that he would not disclose any info about Katlyn, except that she was safe. Det. Reardon continued to ask Rivera to disclose and stated "come on for Katlyn's sake" and so the police know that she is safe. After numerous requests by Det. Reardon and Rivera not disclosing, Rivera stood up in fustration and made the statement, "she (Katlyn) is in upstate New York!" Rivera then stood and tried to walk out of the room, but he was secured to the chair. (Note: Reardon felt that this statment was not consistent with his behavior prior to the statement, Reardon also felt that Rivera was making the statement just to get Reardon off his back. Rivera also stated that he just wanted to go to prison and was tired of questioning).

At 1655 hours (8/11/99), Det. Reardon and Lt. Harris spoke with Jennifer about her conversation with Rivera. Jennifer advised the Rivera only wanted to talk about their relationship and getting back together. Rivera wanted Jennifer to drop charges that she has filed against Rivera (assault charges). Rivera mentioned a female that he called just prior to calling Jennifer's House (believed to be the call from the Exxon Station at 1345 hours, this date). Rivera further told Jennifer that he ripped up the number after completed the call to the female. Jennifer did not give much info.

On Wednesday 08/11/99 at 1720 hours, Det. Reardon contacted the Cora Police Dept. in NY (516-854-8600). Reardon requested they send a uniformed to Rivera's sister's house (Lisa McLarty 31 A Crader Lake Dr. Cora, NY 11727) to determine if Katlyn is present there. A car would be enroute within the hour.

On Wednesday 08/11/99 at 1810 hours, Det. Reardon requested Ptlm. Boyd (UCPD) to respond to the Exxon station and to Sam's Atlantic to check the area of the payphone and the passenger area of the 95 Ford Escort looking for any ripped up pieces of paper with a number on them. At 1845 hours, Ptlm. Boyd advised that he checked both areas as requested and did not locate any ripped up paper at all.

On Wednesday 08/11/99 at 1905 hours, Det. Reardon spoke with Lisa McLarty at HQs. McLarty advised that the Cora PD just left her house at 1830 hours and she was advised to contact Det. Reardon. She was asked if she had heard from her brother, Robert. She indicated that she had not heard from him and wanted to know why Reardon was asking. She was advised that Rivera was in custody and Katlyn was missing. McLarty could not provide any info.

[9] On Wednesday 08/11/99 at 1950 hours, Lt. David Peifer (Del Co. CID) and Special Agent Donna Kibbie (FBI Newtown Square) arrived at UCPD HQS. They were requested by Lt. Harris for their assistance. Both Peifer and Kibbie interviewed Rivera in the Twp. conference room. At 2005 hours, Lt. Peifer advised that Rivera provided information as to what he did with Katlyn. Peifer advised that Rivera took Katlyn to numerous location throughout the day on Tuesday, but at sometime around 8.00pm-8:30pm, Rivera met a female in the gift shop area of Longwood Gardens in Kennett, Pa. He spoke with this female and told her how bad of a mother Jennifer was to Katlyn. He then asked this female if she would take Katlyn and an arrangement was made to meet in the back part of the parking lot outside of the giftshop and entrance. Once outside, they met towards the back of the lot and pulled next to each other next to a light standard. Rivera stated that the female was with a male who was driving the vehicle. Rivera described this vehicle as a qreen Caravan, tinted windows, with Md. tags. (the bay area tag with a herron in the middle). The female was described as 5’7" dark curly hair, dark eyes, thin 130 lbs., regular type glasses, late 20s, early 30s. The male was heavey set, late 30s, some side burns, with dark short hair. At this time, Rivera said he gave the female some info about Katlyn (shots, weight etc.), turned his head, gave Katlyn to her, and walked away (not looking back). The van then exited the lot and he followed shortly after. At this time, Rivera agreed to show police where he made this exchange. (Note: see Lt. Peifer's report for a more detailed description of his interview.)

On Wednesday 08/11/99 at 2050 hours, numerous agencies responded to the Longwood Gardens for the purpose of conducting a search. The list included; troopers and detectives from Media and Avondale barracks, CID Peifer, FBI Kibbie, Ridley Twp PD K-9 (Willoby), and UCPD officers [Harris, Bush, Massey, Reardon, McNichol, Kennard]). The K-9 officers and dogs conducted an extensive search of the area around the parking lot of Longwood Gardens. The searches netted negative results. A man search was also conducted using flashlight with negative results. At 0050 hours on 08/12/99, Lt. Peifer made a phonecall to Rivera's mother, Bonnie Bagley(516-928-5044 #5 Barbara Ave. Fort Jefferson Station, NY). Peifer explained to Bagley the circumstances and requested she speak with Robert in order to determine Katlyn's whereabouts. Bagley did speak with Rivera. Rivera expressed some emotions like crying while speaking with his mom, but expressed the same story to her that he did Peifer. At this time, the search was called off.

On Thursday 08/12/99 at 0100 hours, Det. Reardon canceled the original bolo number for Rivera as a wanted person and re-entered Bolo #017934 with dispatcher #76 for Katlyn Rivera as a Missing Person. The follow was included in the entry. Katlyn Se1ina Rivera / Helton WF DOB 12/12/97 (20 months) brown eyes, dirty blonde hair, 23 lbs., 30 inches, with a birthmark on the back of her left shoulder blade.

On Thursday 08/12/99 at 0150 hours, Det. interviewed Dominic DiaGiacomo (2601 Chichester Ave. Boothwyn, Pa.) about his relationship with Robert Rivera. DiaGiacomo’s first response was "who?". Det. Reardon showed DiaGiacomo a photo of Rivera. DiaGiacomo stated, "Ah, Rob, he's cool, I ain't seen him for about a week.

[10] On Thursday 08/12/99 at 0215 hours, writer obtained a copy of an interview, Ptlm. McNichol, had conducted with John Leonard McCabe "Jake (22 Constitution Dr. Chadds Ford, Pa. 19317 610-388-2325 DOB 12/13/82. McCabe was the gas attendant at the Sunoco Station at Rt. 1 & Rt. 100 in Chadds Ford. McCabe reports seeing Rivera in the Escort at about 8pm in his station getting $2 worth of gas. Then again around 10 pm getting $10 worth of gas. McCabe pumped his gas each time. McCabe did not recall seeing the child in the vehicle on the second visit. Also, Rivera used the bathroom on the second visit. The contents of the trashcan was retained as evidence by McNichol and turned over to Lt. Peifer. (Note: see McNichol notes for more info). At this time, Rivera was transported to a Media Boro PD holding cell to, by Ptlm McNichol (UCPD), to await his arraignment.

[11] On Thursday 08/12/99 at 0800 hours, at Media Boro HQs, Lt. Peifer was met there by Rivera's welfare caseworker, Sherry Lancianese (Work address: Crosby St. in Chester 610-447-3166 / Home: 699 Cherrytree Rd. Aston, Pa. 610-497-7871). Lancianese offered her assistance, because Rivera made contact with her on Tuesday 8/10/99 and advised her that he did something wrong, he kidnapped his child. He was distraught, but did not elaborate on details with Lancianese. Lancianese did speak with Rivera with Peifer present, but the location of Katlyn was not disclosed. (Note: See Peifer’s report for details.)

On Thursday 08/12/99 at about 0900 hours, Rivera is asked by Lt. Peifer to take a Polygraph exam. Rivera expressed concerns about taking it and asked if the examiner was going to ask him ”if he killed his kid!” After that, Rivera requested an attorney to consult.

On Thursday 08/12/99 at 1012 hours, Det. Reardon and Det. Corsi (CID) transported Robert Rivera to Linwood District Court for his arraignment. Rivera was arrainged at 1109 hours, by Judge Rocco Gaspari on three seperate warrants. The bails for the charges in this case (Agg Assault, Burglary, Kidnapping etc) was set at $100,000.00 cash. The bail for the Protection from Abuse violation warrant for this case was set at $5000.00 @ 10%. There was also bail set for a second private Protection from Abuse warrant, set at $5000.00 @ 10% Rivera could not make bail and Det. Reardon optained three commitment papers for Rivera for Delaware County Prison. Reardon and Corsi then transported Rivera back to Media Police HQs.

On Thursday 08/12/99 at 1202 hours, Det. Reardon contacted The Agency for Missing & Exploited children and spoke with Nancy. The info on the incident and Katlyn's personal facts were past onto Nancy. Same was entered into their system. Nancy also provided a local number for poster help (610-437-2971).

On Thursday 08/12/99 at 1308 hours, Public Defender Al Gretto arrives at Media HQs. He is advised of the charges and re1ated incident invo1ving Rivera. He was then advised that police main interest was locating the child. He agreed to attempting to get that info.

On Thursday 08/12/99 at 1335 hours, Det. Reardon obtained a written statement from Olga Helton with reference to the third phone call to her home on 08/11/99 at about 1045 hours from Rivera. Olga wrote down her recollection. (Note: See report for details).

On Thursday 08/12/99 at 1347 hours, Det. Kelly & Det. Costello returned from an interview with Michlle Lupi (owner of Escort). They questioned the inventory search of the Escort at the time of Rivera's arrest. Their concerned revolved around Lupi stating that she had a cooler in the trunk of the car (A Coleman flip top [2' by 1'] green bottom and white top. Det. Reardon advised that no cooler was located in the trunk during an inventory search of the vehicle at the time of arrest. The towsheet was provided to Lt. Peifer.

On Thursday 08/12/99 at 1400 hours, a TIMELINE of Rivera's travels is developed by Lt. Peifer. Refer to copy of timeline for details.

On Thursday 08/12/99 at 1420 hours, Mr. Gretto returned from his conservsation with Rivera. Gretto's version of Rivera statement was consistent with the statement Rivera privoded the police. Gretto was requested to ask Rivera about the alleged cooler in the trunk of the Escort. Gretto complied with the request, asked Rivera, and advised that Rivera indicates he knows nothing about a cooler. Gretto also advised that Rivera states that Rivera states that the white female he gave Katlyn to referred to the male drive of the van as Scott or Steve.

[12] On Thursday 08/12/99 at 1445 hours, Det. Reardon requested Cpl. Kenneth Allen (UCPD) to respond to Sam’s Atlantic and take polaroid photos of the Ford Escort that Rivera was driving. At 1515 Hours, Det. Reardon obtained numerous Polaroid photos of the Escort showing all four sides of the vehicle. These photos were then turned over to Lt. Peifer. On Thursday 08/12/99 at 1630 hours, Det. Paul Corsi (CID) was requested to complete sketch composites of the male and female that Rivera states he gave Katlyn to. The female composite was completed and turned over to Lt. Peifer. The male composite was started, but not completed until Friday (08/13/99).

On Thursday 08/12/99 at 1650 hours, SA Donna Kibbie (FBI) received a phone call from Jerry Whittaker (849 Ellston Rd. Aston, Pa. 610-558-2802 (W) 610-644-4665). Jerry Whittaker advised Kibbie that she is the mother of Tom Whittaker and mother-in-law of a Sissi Whittaker. Tom and Sissi live at 34 Wood Duck Lane in Elkton, Md. Jerry advised that Tom and Sissi at one time were the neighbors of Robert Rivera and Jen Helton while they lived at 2806 Chi Ave. #1. in Boothwyn. Jerry further stated that Sissi came to visit her this morning (8/12/99) and upon arrival, Jerry said to Sissi, "did you see what your old neighbors are up to (refering to an article in the Daily Times about Rivera taking Katlyn)? Sissi avised Jerry that Robert Rivera spent the night at her home on Tuesday night (8/10/99). At this time, SA Kibbie requested an Agent from the Wilmington FBI office to respond to Sissi and Tom Whittaker’s residence for an interview.

On Thursday 08/12/99 at 1750 hours, a constable was requested to transport Rivera to Delaware County Prison (DCP).

On Thursday 08/12/99 at 1935 hours, Det. Reardon, SA Kibbie, Det. Costello and Det. Kelly (CID) responded to the Longwood Gardens in Kennett, Pa. for the purpose of meeting PALISADES Search and Rescue team (Exxon, Pa.) for another search of the grounds. Said search was coordinated by SA Kibbie. Also, Det. Reardon and Det. Costello, along with Det. Trp. Todd Hersey (PSP-Avondale, Pa.) conducted interviews of all the Longwood Gardens personnel that were working on Tuesday evening (8/10/99). Numerous interviews were conducted to determine if anyone had observed Rivera or Katlyn in the building area of the entrance on Tuesday eveing. No one was able to ID Rivera or Katlyn by photos that were provided. (Note: See Det. Costello's report for names of those interviewed).

On Thursday 08/12/99 at 2200 hours the interviews and search were completed, both with negative results. At this time, SA Kibbie advised on the results of the Tom and Sissi Whittaker interviews. In summary, the Whittakers advised that Rivera shows up at the residence on Tuesday evening around 2100 hours, telling them he is locked out of his apt. and needed a place to sleep. The Whittakers reluctantly agreed to allow Rivera to stay one night. Oddly, Rivera parks the car he was driving (the Escort) in the rear of the residence behind a shed as if to hide the car. Tom and Rivera apparently consume some alcohol outside of the residence and Rivera sleeps on the couch. Tom gets up about 0800 hours and notices Rivera is still sleeping. Tom takes a shower and by the time he is finished, Rivera is up and out of the residence. At this time, Tom hears a door slamp and looks outside. He thought Rivera was sneaking away, but he then noticed that the door to his outhouse was closed and it is always open when no one is inside. Tom assumed Rivera was inside the outhouse. Rivera was gone for 20 to 30 minutes, but he then returns to the inside of the residence. Rivera talks some and then leaves about 0900 hours. Tom did state that he did walk outside and check the car that Rivera was driving thinking it may have been stolen. Tom said he did not notice anything unusual about the car. (Note: See SA Kibbie's report for details)

[13] On Friday 08/13/99 at 0935 hours, investigators (including writer, CID Det. Peifer, Kelly, & Costello / FBI SA Kibbie / PSP trooper Todd Hersey) along with several search & rescue teams (including East Coast S&R and Delaware Valley S&R) responded to 34 Wood Duck Lane Elkton, Md. for the purpose of conducting a search for Katlyn Rivera. Said search included dividing the rear of the property at 34 Wood Duck into sections and searching each section methodicly using dogs. A grid search was also conducted to the rear of the property using 12 persons walking arm length apart looking for any disturbed earth. Furthermore, the search & rescue teams walked along the shoreline, which is directly across the dirt street from 34 Wood Duck Lane., approximately 100 feet away. At this time, these search did not produce any evidence for the presences of Katlyn Rivera. (Note: Refer to the Search & Rescue teams report for more details)

On Friday 08/13/99 at 1630 hours, Det. Reardon responded to 2623 Sharpless Ave, for the purpose of having Jennifer Helton sign a medical release form for the pediatric medical records for Katlyn Rivera. Jennifer did sign said form and form was placed in file. Det. Reardon, at SA Donna Kibbie’s (FBI NS) request, obtained the following items from Jennifer Helton; several items containing Katlyn Rivera's saliva/DNA (including a toothbrush, two pacifiers, and a hairbrush (these items were turned over to SA Kibbie) several photographs of Katlyn Rivera, Jennifer Helton, and Robert Rivera as well as personal items of Katlyn Rivera (these items were turned over to Lt. Det. Peifer (CID) for investigation purposes. (See property record for chain of custody)

On Friday 08/13/99 at 1700 hours, Det. Reardon responded to the work place of Michelle Lupi (owner of Ford Escort) for the purpose of having her sign a consent form for examination of her vehicle by the FBI evidence collection team. When Det. Reardon advised Lupi of the purpose for consent to examine the vehicle (looking for blood, fibers etc)., Lupi advised Det. Reardon that her son is a nose bleeder and that there may be some blood on the bottom inside panel of the passenger door that belongs to her son. At 1830 hours, Det. Reardon spoke with Ptlm. Gray (UCPD) by phone. Gray was at Sam's Atlantic Auto Body with the FBI Evidence Collection Team. Reardon had Gray advise the team of the blood location of the passenger door. Gray advised that the FBI was made aware. Det. Reardon also contacted SA Kibbie by phone and left a message on her voice mail advising her of the blood location.

On Friday 08/13/99 at 1835 hours, Det. Reardon received a faxed report from Pt1m. Scott Whiteside of West Chester Boro PD (610-696-2700) regarding a possible siqhtinq of Katlyn Rivera and the couple described in the composites. (Note: the male composite had not been distributed yet). Whiteside received a report from a Kim DeVallentino (605 W Market St. #16 W. Chester, Pa. 610-429-8028). DeVallentino reports that on Thursday 08/12/99 at about 1730 hours, she may have seen the kidnapped victim from Upper Chichester at the Wawa on Rt 162 in W. Chester. She saw a small child in the company of two adults getting into a blue minivan with out of state tags. Det. Reardon contacted DeVallentino for a follow up interview. She advised that while she was at the Wawa, she observed this strange couple. This couple purchased a large amount of items that filled a shopping cart and spent a lot of time at the check out line. DeVallentino advised this officer that she observed 2 children with this couple and now that she has thought about them, she knows that one child was a boy about 6-7 y/o and the other was a female, but much older then 20 months. DeVallentino said that they got into a van (possibly green, not blue like she advised WCPD) with a white tag (NFD). DeVallentino then stated that she only reported this couple, just incase the missing child was in the van, (Note: an interview sheet was completed and turned over to Peifer).

[14] On Friday 08/13/99 at 2000 hours, Det. Reardon contacted the manager of the Sunoco Station at Rt. 1 & Rt. 100, Janet Smith (610-344-9417). This officer requested a confirmation of the times that Rivera had purchased gas at her station on 08/10/99. Smith advised that she will check the receipts and get back to this officer.

On Saturday 08/14/99 at 1130 hours, this officer received contact from Janet Smith. Smith advised that she confirmed that Rivera purchased $2.00 worth of gas at pump 5 at 1917 hours on 08/10/99 and $10.00 worth of gas at pump 5 at 2116 hours on 08/10/99. (Note: Trooper Todd Hersey PSP Avondale retained the original receipts from pump five and has turned them over to Lt. Peifer).

On Saturday 08/14/99 at 1518 hours, Det. Reardon re-interviewed Jacob McCabe (attendant at the Sunoco Station Rt. 1 & Rt. 100 on 8/10/99). This officer only requested to confirm whether or not Katlyn was in the vehicle Rivera was driving when he returned to the gas station the second time (2116 hours). McCabe indicated that the child was not in the passenger area. He pumped gas into the car himself and was standing right next to the car and did not see anyone other then Rivera in the car.

On Monday 08/16/99 at 1200 hours, Det. Reardon completed a search warrant requesting the clothing (top, jeans, sneakers, & socks) of Robert Rivera. The search warrant was approved by DA Reilly Jr.

On Monday 08/16/99 at 1330 hours, Det. Reardon obtained, from Det Corsi (CID), copies of the completed composites. They were placed in the file.

On Monday 08/16/99 at 1400 hours, Det. Kelly (CID) advised that he and Det. Costello (CID) just returned from an interview of Michelle Lupi. Kelly further advised that they confirmed that the Coleman Cooler that Lupi advised was missing from her trunk has been located at a friend’s house in Linwood, Pa. Both Kelly and Costello responded to the friend’s residence, with Lupi, and confirmed that the cooler was there (Note: See Kelly's report for details).

On Monday 08/16/99 at 1415 hours, Det. Reardon received a report from Chief Robinson (UCPD) of a possible sighting of Katlyn Rivera. Said report came from a Regina Lightheart of the Pa. Dept of Revenue (610-447-3240). An anonymous employee in her office believed to have seen a child resembling Katlyn at Domestic Relations on 08/12/99 at 1600 hours. Det. Reardon did follow up this info with negative results (Note: See interview sheet for details).

On Monday 08/16/99 at 1615 hours, Det. Reardon responded to Judge Cappelli's office and had the search warrant for Rivera's clothes signed and sealed (Warrant Control # 0883378 Docket # CR-412-99). At 1705 hours, Det. Reardon responded to Delaware County Prison and seized Rivera's jeans, jean hooded top, and sneakers (his socks were in the wash). Reardon used rubber gloves and put each item in a seperate bag.

On Monday 08/16/99 at 1745 hours, Det. Reardon responded to 2623 Sharpless Ave. Jennifer Helton was advised that the Preliminary Hearing scheduled for 08/17/99 has been continued. Reardon also collected Katlyn’s bedsheet, a pair of Katlyn's sandals, and a t-shirt of Katlyn's from Jennifer to be utilized in a subsequent search. These items were turned over to Lt. Peifer as evidence (Note: see property record form)

[15] On Monday 08/16/99 at 1830 hours, Lt. Peifer advised Det. Reardon that interviews were conducted of the passengers on a Christian Fellowship tour bus that was at Longwood Gardens on 08/10/99 (evening). None of the passengers indicated that they observed either Rivera or Katlyn (Note: see the list in the file for details).

[16] On Tuesday 08/17/99 at 0755 hours, Det. Reardon spoke with a William Voglel (1425 Gown Point Rd. Chesepeake City, Md. 410-865-2371). Vogler wanted to report a sighting of a baby stroller in a wooded area about 20 feet off the roadway on Courthouse Point Rd. about 1/2 mile in from Rt 213 in Elkton, Md. Writer did respond and examine the stroller on 08/18/99 at 1357 hours. Writer determined that said stroller had been there for quite some time, due to the rust and amount of pine needles covering it.

On Tuesday 08/17/99 at 0800 hours investigators met at 34 Woodduck Lane in Elkton. Md. for the purpose of a search and rescue operation using a bloodhound dog and Rivera's clothing. Cpl. Erik Fogle (Maryland State Police 1-800-811-1981) conducted a search utilizing Rivera's clothing. The clothing was placed in the center of the yard. On two occasions, his dog went right to the outhouse at the rear of the yard. Cpl. Fogle advised that his dog did not show any interest in going into the wooded are behind the outhouse and he had to force his dog to go into the woods. Also on location during this search was the following; The FBI (Janet Crawford, Donna Kiddie, Greg Ault), CID (Peifer, Kelly, Costello), UCPD (Reardon), Cecil County Sherrifs (Cpt. Plummer, Det. Erwin), Maryland State Police (Fogle), and PA State Police (Trp. Hersey). The following Search & Rescue teams were also present; Del Val S&R, Palisades S&R, and West Jersey S&R.

On Tuesday 08/17/99 at 0930 hours, Boulder Enterprises (Elkton, Md. 410-398-9060) was contacted for the purpose of cleaning out the outhouse. A Tim Bouldin responded and after cleaning out approximately 1.5 feet of waste determine that there was nothing but waste in the outhouse.

On Tuesday 08/17/99 at 0930 hours, Det. Reardon interviewed Joe Valentine (18 Kirk Rd. Concord, Pa. 610-361-7965). Valentine advised that he is in the process of taking over 2804 / 2806 Chi Ave. as owner. He was at that location on Monday 08/09/99 speaking with the current owner, Rich Yourgalite. He then advised that Rivera approached him and joined their conversation. At one point, Rivera started telling Valentine about this couple that moved out and went to Maryland and they owe back rent. Rivera was somewhat bragging that he knew where they moved to. Valentine thought this info would be helpful. Reardon advised that the police already know about the couple from Maryland (Couple is Tom & Sissi Whittaker).

On Tuesday 08/17/99 at 1020 hours, the search and rescue teams searched along the water across from 34 Wood Duck Ln and several of the dogs gave strong indications along the water from a dock at 5 Blair Shore Rd down river about 500 feet. At 1345 hours. the Maryland Natural Resource Police responded (Ofc. Ingerson, Cpl. Carpenter, Cpl. Richardson, ofc. Price, ofc. Wolfkill) along with the Chesepeake City Fire Dept Search & Rescue. A dragging of this area out from shore about 300 took place with negative results.

On Tuesday 08/17/99 at 1600 hours, Evergreen Car Wash on SR 322 in Boothwyn advised that they had an application for Robert Rivera that was filled out in May 99'. Cpl. Allen (UCPD) responded to the business and picked up said application. A copy was given to Peifer at CID.

On Tuesday 08/17/99 at 1605 hours, a PA trooper Madey of the King of Prussia barracks (610-279-1605) faxed a report of a possible sighting of Katlyn. A women reported seeing a Van Pa. TJX097 on the turnpike with a child inside resembling the baby. A subsequent follow up revealed acurate info but not the child (Note: see interview sheet for details).

[17] On Tuesday 08/17/99 at 1838 hours, a Pat Yermac (505 Hillcreast Ln. Wilm., De. 302-762-8353) reported a sighting behind Ron's Discount Tire at 40th & Washington in Wilm., on 08/11 or 12/99 in a older large car De. 34574. A subsequent follow up revealed nothing suspicious about the car or it's owner (Note: see interview sheet for details).

On Tuesday 08/17/99 at 1840 hours, an Ennis Parent (640 Johnson Ave. Linwood, Pa. 610-497-6217) reported a sighting of the female in the composite. He observed a female passenger of a dark purple Plymouth Voyager MD MO54684 exit I-95 NB at Chi Ave. make a left and get back on I-95 SB. This occurred on Saturday 08/14/99 at 1000 hours. Writer checked said tag through CLEAN and it came back “no record found." Writer passed this info onto FBI SA (NS) Nancy O'Dowd on 08/18/99 for a follow up. (Note: see interview sheet for details).

On Wednesday 08/18/99 at 0800 hours, investigators were on location at 5 Blair Shore in Elkton, Md. for the purpose of using a dive team to search the shore area at 5 Blair Shore, where the dogs made several indications on 08/17/99. Upon arrival, Tom Whittaker approached Det. Reardon and advised that he is sure of the time Rivera came to his home on 08/10/99. Whittaker advised that he now recalls that he was at his neighbor's house (Joe) visitinq on Tuesdav 08/10/99. Joe's wife teaches a class in Elkton and leaves class and 2200 hours. It takes her 10 minute (or so) to get home. Whittaker advised that when Joe's wife got home, he left and walked to his house. Upon his arriyal at his home, Rivera arrives, which is about 2215 hours. This info was provided to Lt. Peifer for Time Line purposes. At 0845 hours the Maryland Resource Police Dive Team conducted their search. The team consisted of Cpl. Carpenter, Ofc. Price, Cpl. Kilwolf, and ride along Mike Leishear. The divers were Cpl. Garren, Ofc. Carey, Ofc. Atkins, and Ofc. Pavon. Their search consisted of a four-man shoulder to shoulder grid-walk of the area at 5 Blair Shore 500 feet down river, and 500 feet out towards the middle. Their search was neqative.

On Wednesday 08/18/99 at 1350 hours, Det. Reardon was provided copies of subpoenas for payphone records from Lt. Peifer. Same were filed.

On Wednesday 08/18/99 at 1349 hours, Det. Reardon contacted Lima District Court and spoke with Tonya (610-565-4110) with reference to two outstanding for Robert Rivera and Jennifer Helton. Tonya advised that the warrants stem from retail theft citations that were issued by Trp. Dugan (PSP Media). Tonva further advised that Rivera pled guilty to the citation and was entered into the STOP program, but he failed to appear to any further proceedings. A detainer will be placed on Rivera by Lima Court. The court will handle the warrant for Helton. Info given to Lt. Peifer.

On Wednesday 08/18/99 at 1420 hours, Det. Reardon faxed copies of the warrant and report to Det. James Vito of Chester County CID (610-565-4110). This was done at Lt. Peifer's request for informational purposes.

On Wednesday 08/18/99 at 1500 hours, Det. Reardon returned the search warrant for Rivera's clothing to Concordville District Court (Judge Cappelli).

On Wednesday 08/18/99 at 1505 hours, Det. Reardon contacted and spoke with Judge Rocco Gaspari at Linwood District Court with reference to his name being on Robert Rivera's Evergreen Car Wash job application as a reference. He advised that he knows nothing about his name being there and did not give Rivera permission to use his name.

[18] On Thursday 08/19/99 at 0900 hours, Det. Reardon responded to the Greener Nursery (4 Woodland Dr. Glen Mil1s, Pa 610-459-8388) and spoke with manager Peggy Novoteni about Rivera being employed there. Novoteni had nothing substancial to report except that when Rivera worked there (in 1996), they had some money stolen, but they are unsure if Rivera was responsible (See interview sheet for details).

On Thursday 08/19/99 at 1020 hours Det. Reardon responded to 2100 Bayard Drive in Wilm., De. to Dr. Fucci’s office. Writer obtained Katlyn Rivera's medical records. These records were turned over to Lt. Peifer.

On Thursday 08/19/99 at 1040 hours, Det. Reardon responded to the Produce Junction located on Chichester Ave. in Boothwyn and interviewed manager Sam McIntosh to follow up on info received that Rivera frequented this location. McIntosh was shown Rivera's photo and stated that he has never seen Rivera in his store. Furthermore, McIntosh advised that his workers are Columbian and not Pueto Rican and most people get the two confused. He also said that his workers live in New Jersey and go right home after work (See interview sheet for details).

On Thursday 08/19/99 at 1109 hours Det. Reardon responded to 234 A Pennell Road in Aston, Pa. to Dr. Bradbord's office. Writer obtained Katlyn Rivera's medical records. These records were turned over to Lt. Peifer.

On Thursday 08/19/99 at 1200 hours, Det. Reardon interviewed Gary McCleaft Sr. (2806 Chichester Ave. #1 Boothwyn, Pa. 610-485-2729). McCleaft advised that he only seen Rivera in the rear lot several times. Rivera had asked McCleaft about visitation and custody issued, because McCleaft is seperated from his wife. McCleaft provided Rivera with some advise. McCleaft and Rivera also discussed Rivera's sister coming down from New York to bail him out of bail or something. The sister was also down right after Rivera and Helton fought and Helton moved out. The sister was parked in the rear in a dark blue or green firebird (See interview sheet for details).

On Thursday 08/19/99 at 1220 hours, Det. Reardon interviewed Kim Loyld (2806 Chi Ave. #2 Boothwyn no phone). Loyld had just moved into the complex and did not know Rivera (interview sheet completed).

On Thursday 08/19/99 at 1220 hours Det. Reardon interviewed John Taylor (alleged Hoover gang leader) in the 2800 block of Chi Ave. Taylor advised that he meet Rivera around 07/31/99 when he went to look at the apts. at 2806 Chi Ave. Taylor did recall that on the Saturday or Sunday before 08/10/99, Rivera was talking with him at Blickley's house (1800 Chi Ave.). Rivera was talking about kidnapping his daughter and Taylor was asking him why. Rivera told Taylor that he was upset about his custody being taken away and when he visited with Katlyn, the grandparents would cut him short. Taylor asked him how he would do it and Rivera talked about stealing a car, asking his sister for help, and taking Katlyn to New York or Pueto Rico. Taylor also mentioned Rivera talking about knowing people in Chester County with a nice house.

On Thursday 08/19/99 at 1800 hours, investigators met with Delaware County Prison immate William Lively. Lively indicated he had info for investigators regarding Rivera and Katlyn. Lively's attorney was also present. Lively had conversations with Rivera in prison and stating that he feels the child is someplace in the area of the Whittaker's residence in Md. It was felt that Lively did not produce any info that investigators were not already aware of. Lively was told to keep speaking with Rivera and that the child must be found before any agreements with him could be considered (See Lt. Peifer's report for details about Lively).

[19] On Friday 08/20/99 at 0750 hours, Det. Reardon responded to 144 B Jones Dr. in Linwood and interviewed James Turner. Turner is an old neighbor of Rivera that Jennifer Helton stated Rivera would purchase controlled substances from. Turner knew Rivera as a neighbor about 6 to 8 months ago. He socialized with Rivera several times (drank a few beers with Rivera from time to time). Turner advised that he did not like Rivera, because of the way he treated Jennifer (abuse etc.). He recalled one incident where Rivera threw a pumpkin through the window of a car that Jennifer was sitting in out in front of their Jones Dr apt. (See interview sheet).

On Friday 08/20/99 at 0815 hours, Det. Reardon responded to 1312 McKay Ave. and spoke with Rebecca and Linda Scone, neighbors of Rivera (his Chi Ave. apt.). They both indicated that an FBI agent had already interviewed them. They indicated that they knew Rivera as a neighbor that always hung out back of his apt. Katlyn would play in their sand box. They did not provide any significant info. (See interview sheet).

On Friday 08/20/99 at 0830 hours, Det. Reardon responded to 2908 C Chichester Ave. to interview Heather Mayka (Heather is a former girlfriend of Rivera). She advised that she dated Rivera in July of 1998 for about 1 month. While dating Rivera, Heather knew of Jennifer. Rivera told her that they were just friends, even though Rivera was living with Jennifer. Rivera would stay at Heather place when they were dating. They would never go to Rivera's place. Rivera did ask Heather to marry him and gave her a ring. Heather said she would have to think about it, but two days later, he took the ring back. Heather felt the ring belonged to Jennifer. Rivera told Heather that things were moving to fast. Several days later, Heather told him that she did not want to see him anymore. Rivera started calling and paging her all the time. He even would sleep in front of her apt. Rivera then asked her if it was over, she said yes, and he left her alone. During their week long breakup, Rivera did call one night from the Wawa on Chi Ave. stating that he could not take it anymore with Jennifer. He said he was going to New York and he wanted to take Katlyn with him, but Jennifer would not leave Katlyn alone.

On Friday 08/20/99 at 0930 hours, Det. Reardon responded to Michelle Lupi's house on Bethel Rd. in Chester Twp. and returned the items from her trunk to her father. A property receipt was signed.

On Friday 08/20/99 at 1000 hours, a meeting was held at CID HQs. It was learned from Trooper Hersey (Avondale PSP) that from Rt. 1 & Rt. 100 to 34 Woodduck Lane in Elkton is 37.9 miles and takes about 55 minutes one way. It was also dislosed by Det. Kelly that Michelle Lupi believes that a tire iron is missing from her trunk, but at this point a tire iron is not an issue in the investigation.

On Friday 08/20/99 at 1200 hours, Det. Reardon and Chief Robinson met with Jennifer Helton at her residence. Jennifer was brought up to date on the investigation.

On Friday 08/20/99 at 1450 hours, Det. Reardon responded to 1800 Chi Ave. and interviewed Rick Blickley. He stated that he knew Rivera for about 1 week before the 8/10/99 incident. He hung out with Rivera several times at his home. Rivera was cool with Shawn Holten so Blickley thought he was cool. Blickley did hear some of Rivera talking with John Taylor about being fustrated with not seeing his child. Nothing else substantial (see interview sheet for details).

[20] On Friday 08/20/99 at 1620 hours, Det. Reardon spoke with Phylsis Watts of the Center for Missing/Exploited Children (610-437-2971). Watts requested info about the case in order to create a poster for Katlyn. Same will be mailed to HQs.

On Friday 08/20/99 at 1700 hours, Det. Reardon responded to CID HQs and obtained info wanted posters made by Sgt. O'Berg. Several posters were mailed to Ray Stackhouse at the Phila Airport (610-362-7940) and a request to post same was made.

[21] On Saturday 08/21/99 at 0730 hours, Det. Reardon interviewed Belinda Nunes of 2804 Chi Ave. Apt. #2 Boothwyn, Pa. 610-497-6203. Nunes indicated that she has only lived at the apt. since March of 1999 and only knew Rivera as a tenant that lived below her. Her impression of him was that of a jerkoff. One issue of importance is that it was learned that Nunes telephone line was somewhere hook up into Rivera's old apt. Nunes will correct this problem with the phone company. When her bill comes in, if there are any numbers on that bill that she did not make calls to, she will notify the police. (See interview sheet).

On Saturday 08/21/99 at 0800 hours, investigators responded to the Brandywine River Meuseum on Rt. 1 in Chadds Ford, Pa. for the purpose of a Search & Rescue mission. This mission is in reference to Rivera mentioning the river while in custody on 08/10/99. Law enforcement on location consisted of UCPD (Reardon), CID (Peifer, Kelly, Costello), FBI (Kibbie), and PSP (Media and Avondale). Search and Rescue teams on location were Del Val S&R, East Coast S&R, Palisades S&R, and West Jersey S&R. The entire area was searched including the wooded area behind the parking lot and along the river bank, all with negative results. Kibbie(FBI) and Palisades S&R also responded back to the Longwood Gardens location near the cemetary for an additional search with negative results. Investigators cleared at 1300 hours.

On Saturday 08/21/99 at 0930 hours, during the search and rescue mission, Det. Reardon contacted and spoke with Richard Yourgalite, the title holder for 2804 and 2806 Chi Ave. He is setting up a lease purchase deal of the building to Jsoeph Valentine (interviewed earlier). Yourgalite only knew Rivera as a tenant. One piece of info that is relevant is that Tom and Sissi Whittaker were former tenants at the building. When they left, they owed back rent. Rivera told Yourgalite that he knew where the Whittakers moved to and Yourgalite drove Rivera to that location (34 Woodduck Ln in Elkton, Md). Yourgalite advised that when he arrived at the residence, he noticed the deplorable condition of the trailer and decided that it was not worth going after the Whittakers, so he turned around and they drove back to Boothwyn. (See interview sheet).

On Saturday 08/21/99 at 0950 hours, during the search and rescue mission, Det. Reardon contacted and spoke with Daniel Fogle. Fogle was a former co-worker of Rivera's at Jack's Nursery in 1996. Fogle advised that he only hung with Rivera through work. He recalls a bit of a problem with Rivera, because he (Fogle) was younger then Rivera and was his supervisor. Rivera did not work at Jack's long, because he was accused of stealing some company checks. Fogle does recall going to Rivera's residence after work once or twice, when Rivera lived on Zebley Rd in Bethel. They went there to cut the grass. Fogle knew Rivera was dating a girl that lived there and just started dating Helton right before he left the business. Fogle did state that he knew Rivera had come from New York and had relatives up there. No further info. (See interview sheet).

On Saturday 08/21/99 at 0930 hours, during the search and rescue mission, Det. Reardon contacted and spoke with Jim D'Amicis. D’Amicis was an associate of the Hoover gang. D'Amicis recalls Rivera coming around Blickley's house (1800 Chi Ave.) several times, only several weeks ago. D'Amicis states he barely spoke to Rivera, but on Saturday 08/07/99 around 1300 hours, he recalls walking from Blickley's with Rivera, to Rivera's apt. for something to do. There was not much talk, except that Rivera mentioned that his sister was coming down from New York to pick up some clothes and furniture. D'Amicis never saw the sister, infact, he waited out front of the apt. while Rivera went inside. (See interview sheet.)

[22] On Monday 08/23/99 at 1000 hours, Lt. Peifer advised Det. Reardon that he received informant information about a possible location of the missing Whittaker shovel. This info indicated that the shovel was at a construction sight in Md. near the Whittaker's. At 1300 hours, Det. Reardon received info from Lt. Peifer that the shovel was location at a construction sight on Rt. 40 in Elkton, Md. just south of the Delaware state line. This shovel was positively ID’d by Tom Whittaker and was taking as evidence by Cecil County Sherrifs. A search of the construction sight using Search and Rescue teams (dogs), law enforcement, and construction equipment netted negative resutls. (See Peifer's report for details).

On Monday 08/30/99 at 1200 hours, Det. Reardon spoke with june Mayka of 2908 C Chi Ave. in Boothwyn. Mayka wanted to advised police that her newphew (Tim Redden, Blickley's neighbor), observed Rivera at Blickley's house on the night of the kidnapping (8/10/99). A follow up contact to Redden revealed that he actually observed Rivera on Monday (8/9/99), the night before the kidnapping.

On Monday 08/30/99 at 1300 hours, Det. Reardon met with Jennifer Helton and advised her that posters from the Center for Missing/Exploited Children were received. Det. Reardon confirmed with Helton the info on the posters as acurate. Helton also had received numerous poster. Said poster were distributed among law enforcement. Helton to distribute among businesses.

On Monday 08/30/99 1700 hours, Det. Reardon contacted Joseph Valentine (2804 #1 Chi Ave. Boothwyn 610-364-0384 Rivera's old apt.) with reference to obtaining info on the location of possible photos found in Rivera's apt. during the clean out. Valentine advised that he, along with two friends (Melissa Forrester and Angel Klum), cleaned out the apt. He advised that Forrester found about photos in a pocket of a flannel shirt in the living room closet. These photos displayed Jennifer Helton in various sexual positions (nude). There was also an unknown male (torso down in several of the photos. Helton's phone number was on the back of each of these photos. Valentine advised that he told Forrester to throw the photos in the trash and he observed her do so. (See interview sheet)

On Monday 08/30/99 at 1715 hours, Det. Reardon received a call from Belinda Nunes of 2804 Chi Ave. Apt. 2. Boothwyn, Pa. (610-453-1077). Nunes wanted to report anonymous info that she has a relative in Delaware County Prison that has heard (third hand) that Rivera has talked about sending the child out of the country. This info was passed onto Lt. Peifer. (See interview sheet).

On Monday 08/30/99 at.1730 hours, Det. Reardon spoke. with David Cassidy of 2804 Chi Ave. Apt. 3. Boothwyn, Pa. Cassidy advised that he and his finance have rented the apt., but have not mored in yet. They don't know Rivera. (See interview sheet).

On Monday 08/30/99 at 2210 hours, Det. Reardon spoke with Dolores Smith of 26 Leedom Rd. in Elkton, Md. 410-398﷓7732. Smith wanted to report a possible sighting of the child at the MacDonald's at the Rt 279 truck stop in Elkton, Md. on 08/19/99 at 1500 hours. Smith observed a child resembling Katlyn with a couple that got into a white van with NJ WA-798 or NJ WA-791.

On 08/31/99 at 0800 hours, Det. Reardon provided this info to Lt. Peifer who indicated that he had already received said info and it was investigated.

[23] On Tuesday 08/31/99 at 0730 hours, investigators responded back to 34 Wood Duck Lane in Elkton, Md. for the purpose of a more extensive search and rescue mission. Law enforcement on location were UCPD, CID, FBI, and Cecil County Sherrif's. Search and Rescue teams were Palisades, West Jersey, Del Val, East Coast, and Phila Police. This search consisted of the entire wooded area behind 34 Wood Duck, the roads leading up to Wood Duck, as well as the water shore line. The search netted negative results.

On Tuesday 08/31/99 at 0930 hours, Det. Reardon spoke with Julia McIlvrid of 923 East 16th St. Chester, Pa. 610-872-8627. Julia McIlvrid is the former mother-in-law of Michelle Lupi. Julia McIlvrid reports that on 08/11/99 at 02300 hours, Lupi showed up at her house looking to spend the night. McIlvrid questioned Lupi about her car and Lupi told her he lent it to a guy to go to court and get his kid. Lupi could have said kidnap his kid, so McIlvrid asked Lupi to confirm this. Lupi said she did not think this guy was serious at the time. McIlvrid did not allow Lupi to stay and she left in a dark color van with a W/M driver. This info was given to Det. Kelly (CID).

On Tuesday 08/31/99 at 1745 hours, while inviestigators were still on location at Wood Duck Lane, Lt. Peifer received info from Prison Counselor Brandon Hickey that he (Hickey) learned thru an informant (William Lively) that Rivera placed the child in a pit about 100 yards from the rear of Whittaker's house at about 10 o'clock. He placed cinderblocks, leaves, sticks, and dirt on the body. Investigator sectioned off this area and searched same (using the dogs) with negative results.

On Tuesday 08/31/99 at 1815 hours, Lt. Peifer received additional info from Brandon Hickey thru the informant, indicating the location of the clothing of the child. The info was that Rivera threw the clothing out the car window along Rt. 202 in Delaware before you get to the Pep Boys in Tallyville. Det. Reardon (UCPD) and Det. Kelly (CID) responded to this area and requested assistance from DSP, UCPD, and Bethel PD.

On Tuesday 08/31/99 at 1835 hours, while enroute to Rt. 202, Det. Reardon spoke with Angel Klum of 207 Pilgrim Ln. APt. B Drexel Hill, Pa. 610-348-5996. Klum confirmed helping Valentine clean out Rivera's apt. and seeing the photos. Klum advised that she observed Foreester throw the photos into the trash. (See interview sheet).

On Tuesday 08/31/99 at 1925 hours, while waiting for DSP, Det. Reardon spoke with Chris McDonald of 34 Thyme St. in Elkton, Md. 410-485-1981. McDonald wanted to report the sighting of a white sandlal just off the roadway near the MacDonald's at the Rt. 279 truck stop. Det. Reardon advised McDonald that investigator were not looking for a sandal, but thanked him for his info. (See interview sheet).

On Tuesday 08/31/99 at 2050 hours, the search along Rt 202 began with the assistance of Cpl. Pam Martin of DSP Troop #1, Ptlm. Mitchel (UCPD), and Ptlm Murphy and Ptlm. Fields (Bethel PD). At 2145 hours, at Rt. 202 south at Helzberg Diamonds, Cpl. Martin located a yellow infant sock on the grass median about 1 foot from the left lane. Det. Welsh (CID) responded to take sock as evidence. At 2245 hours, at Rt. 202 south at Precission Tune, Cpl. Martin located a white size 4 infant sneaker (with a design on the front). Det. Welsh responded to take the sneaker as evidence.

On Wednesday 09/01/99 at 0900 hours, the Preliminary Hearing for Robert Rivera was held at Linwood District Court before Judge Rocco Gaspari. After hearing testimony, Judge Gaspri held Rivera on all charges. Aggravated Assault and five counts of Rescklessly Endangering Other Persons [were withdr---?] by the Commonwealth prior to the start of testimony.

[24] On Wednesday 09/01/99 at 1110 hours, investigators (Peifer, Kibbie, Reardon, Kelly, Costello) responded to 2623 Sharpless Ave. Upon arrival, Jennifer Helton was shown the sock and sneaker that was recovered on Rt 202 as evidence. Helton immediately identified both pieces of evidence as belonging to Katlyn Rivera Helton.

On Wednesday 09/01/99 Lt. Peifer and SA Kibbie responded to CID HQs for the purpose of interviewing prison immate John Flemming. Flemming requested to speak with investigators as he had info related to the Rivera investigation. (See Lt. Peifer's report for details).

On Wednesday 09/01/99 at 1400 hours, investigators responded back to Rt 202 for a more extensive search. UCPD (Reardon, Kennard, Mark, Lindelow), CID (Kelly), and the FBI (O'Dowd, Ault) participated in the search for more clothing. The entire stretch of Rt. 202 north and south bound from Genardi's to Precission Tune was searched with negative results.

On Wednesday 09/01/99 at 2030 hours, investigators responded to 849 Ellston Rd. in Aston, Pa. (Jerry Whittaker's home) for a search and rescue mission. Peifer was asked by informant Lively if Tom Whittaker had a connection to Aston, Lt. Peifer checked the residence and felt that the rear of the yard had similarities to the rear of Tom Whittaker's place ar 34 Wood Duck Ln. Palisades S&R assisted in the mission which netted negative results.

On Wednesday 09/01/99 at 2100 hours, Ofc. Bright of Uwclyn Twp Police 610-458-5862 contacted Det. Reardon and advised that a residence from his Twp. (Jennifer Sen) made a video tape at a local school of a girl that she thought resembled Katlyn Rivera.

On Thursday 09/02/99 at 0900 hours, Det. Reardon contacted and spoke with Ofc. Joseph Carr of Uwclyn Twp. Carr advised that he viewed said tape and described the girl as 4-5 y/o hanging up a school bag in a classroom. This is too old to be Katlyn. (See interview sheet).

On Thursday 09/02/99 at 1300 hours, Det. Reardon responded to 114 W Garison Rd. in Brookhaven to follow up on info received from Regina Lightheart on 08/16/99 at 1415 hours. Det. Reardon spoke with a Kelly Massey. Massey did confirm being at Domestic Relations on 08/12/99 at 1600 hours. Det. Reardon confirmed that the child that was with her at that time was not Katlyn, but rather her child Brittany Geary (13 month old). Info turned over to Lt. Peifer. (See interview sheet).

On Thursday 09/02/99 at 1200 hours, Det. Reardon spoke with Melissa Forrester of 2938 B Chi Ave. Boothwyn, Pa. 610-364-0432 with reference to cleaning out Rivera’s apt. with Valentine and Klum. She confirmed cleaning out the apt. and finding the photos of Jen Helton. She then advised that she throw the photos into the trash at Valentine's request. (See interview sheet).

On Thursday 09/02/99 at 15OO hours, Det. Reardon conducted another search along Rt. 202 down the on-ramp to 95 SB to Delaware Ave. looking for clothing and had negative results.

On Friday 09/03/99 at 0915 hours, Det. Reardon responded to 2804 Chi Ave. and conducted a search of the basement to Rivera’s old apt. Nothing of relevance to discovered.

[25] On Tuesday 09/21/99 at 0830 hours, Det. Reardon received a report from an Alice Knott of 308 Carya Court in Bear, De. 302-834-5736. Knott advised that on Monday evening, 09/20/99 at about 1745 hours, she saw a child that resembled Katlyn on a Spanish new cast on Channel 63, WTVE, out of Reading, Pa. Det. Reardon made contact with Telemundo Network Group (Loraine Penia) of Fl. and requested a copy of the telecast. On 10/06/99, Det. Reardon along with numerous UCPD personnel viewed the tape and concluded that the child was not Katlyn. (See interview sheet).

On Saturday 09/25/99 at 1035 hours, Belinda Nunes of 2804 Chi Ave. #2 in Boothwyn called police to report that she received her phone bill and that there were two numbers on the bill that she did not make calls to. The numbers were 516-928-5044 and 516-928-0939. Det. Reardon contacted Lt. Peifer and learned these numbers belong to Rivera's sister and mother. The bill was retained as evidence.

On Monday 09/27/99 at 1950 hours, police responded to 1800 Chi Ave. and spoke with Judy Blickley. Blickley advised that there were two numbers on her phone bill that she believes Robert Rivera made from her home. Those numbers were 516-928-5044 and 516-928-0939. These are the same number as made from Nunes apt. by Rivera. The bill was retained as evidence.

[26] On Monday 10/18/99 at 0835 hours, Det. Reardon spoke with Emily Smart with reference to Smart having a possible sighting of Katlyn Rivera. Smart advised that on the Saturday after the abduction, she was at the "Funscape" (Rt 202 & Naamans Rd. in Wilm, De). At about 1300 hours, she observed a child at resembled Katlyn with an older male (no description) and another child. Both children were in a stroller. Smart could not provide any further info. This info was passed onto Lt. Peifer (CID). (See interview sheet).

On Monday 10/18/99 at 1400 hours, Det. Reardon contacted a Dennis Fritz with reference to Fritz speaking to Michelle Lupi about the kidnapping. Fritz says that Lupi visited Rivera in prison and Rivera says that Katlyn is alive with relatives in Florida. Lupi tells Fritz that she is afraid to tell the police everything she hears for fear of her safety. Fritz makes an agreement with Lupi that she can tell him what she knows and he will contact the police with the info. Fritz also believes Rivera once talked of having relatives in --mpa, Fl. This info was passed to Lt. Peifer. (See interview sheet).
